HR-116 Employment of Minors

Summary

When employing minors, the University strives to provide a safe learning environment. In accordance with federal and state regulations, a minor less than 18 years of age may be employed by the University as outlined below.

If any part of this policy is in conflict with Collected Rules and Regulations (CRR), the provisions of the CRR will govern.


HR Policy Provisions

  1. 13 Years of Age and Younger
    No minors 13 years of age and younger shall be employed or permitted to work for the University in any occupation at any time, even if parental/guardian consent is obtained.
  2. 14 to 16 Years of Age
    1. Minors between the ages of 14 and 16 may be employed by the University unless the employment is in connection with:
      1. power driven machinery;
      2. the oiling, cleaning, maintenance and washing of machinery, including any type of food processing equipment;
      3. ladders, scaffolding, or their substitute;
      4. the operation of any automobile, truck or motor vehicle or serve as a helper on such vehicle;
      5. the operation of hoisting machines, cranes or freight elevators or any other elevator that might be used for the purpose of carrying freight or supplies;
      6. occupations involving exposure to radioactive substances, or toxic or hazardous chemicals;
      7. loading and unloading goods to and from trucks or conveyors;
      8. manufacturing, mining or processing that requires the performance of any duties in work rooms or work places where goods are manufactured, mined or otherwise processed;
      9. occupations involving:

        1. cooking and baking;
        2. work in warehouses except office and clerical work;
        3. a public messenger service;
        4. outside window washing that involves working from window sills;
        5. work in freezers and meat coolers;
        6. boiler or engine rooms;
        7. communications and public utilities; and
        8. custodial tasks in spaces used as sleeping accommodations; or

      10. in any other occupation dangerous to the life, health or limb or injurious to the health or morals of minors under the age of 16.
    2. A minor in this age group may not be employed during the regular school term unless issued a work certificate.
      1. It is not necessary for a minor over 14 but under 16 years of age to obtain a work certificate for the purpose of working during vacation periods.
      2. Applications for work certificates are issued and signed by, or under the direction of, the superintendent of public schools of the district in which the minor resides. If there is no such superintendent, they are signed by the county superintendent of the county in which the minor resides.
    3. During the school term, minors in this age group may not be employed or permitted to work during school hours except as provided in Work Experience and Career Exploration Programs.
    4. During school term non-school hours, they may not be employed:
      1. before 7:00 a.m. or after 7:00 p.m.,
      2. more than three (3) hours a day on school days including Fridays,
      3. more than 18 hours a week during school weeks,
      4. more than eight (8) hours a day on non-school days or more than six (6) days a week.
    5. Finally, during hours outside the school term, minors in this age group may not be employed:
      1. before 7:00 a.m. or after 9:00 p.m.,
      2. more than eight (8) hours a day,
      3. more than 40 hours in a non-school week or more than six (6) days a week.
  3. 16 to 18 Years of Age
    1. Minors in this age group are prohibited from working in the following occupations:
      1. Work that involves:

        a. handling pesticides or pesticide application equipment;
        b. applying or assisting in the application of pesticides;
        c. entering or remaining in any treated area during pesticide application; or
        d. entering any treated area after pesticide application is complete but before the restricted-entry interval specified on the pesticide鈥檚 labeling has expired.

      2. Work as an operator of or a helper on:

        a. all bending machines, such as apron brakes and press brakes; or
        b. all shearing machines, such as guillotine or squaring shears; alligator shears; and rotary shears;
        c. elevator, crane, hoist or high lift truck, except for the operation of an unattended automatic operation passenger elevator or an electric or air operated hoist not exceeding one-ton capacity.
        d. a crane or hoist.
        e. power-driven fixed or portable machines except machines equipped with full automatic feed and ejection (including setting-up, adjusting, repairing, oiling or cleaning these machines):

        1. ) circular saws;
        2. ) band saws; and
        3. ) guillotine shears.

        f. paper products machines.

      3. Riding on a manlift or on a freight elevator, except a freight elevator operated by an assigned operator.
      4. Operating, assisting to operate, or setting up, adjusting, repairing, oiling or cleaning any:

        a. horizontal or vertical dough mixer,
        b. batter mixer,
        c. bread-dividing, -rounding or -molding machine,
        d. dough brake,
        e. dough sheeter,
        f. combination bread slicing and wrapping machine,
        g. cake cutting band saw, and
        h.  a cookie or cracker machine.

      5. All work involved in construction, wrecking and demolition operations.
      6. All work involved in roofing operations.
      7. Excavation operations, including all excavating, working in or backfilling (refilling) trenches, except manually excavating, manually backfilling trenches or working in trenches that do not exceed four (4) feet in depth at any point.
      8. Motor vehicle driver and outside helper on any public road or highway.

        a. Minors may operate vehicles under 6000 pounds gross vehicle weight during daylight hours.

      9. Work that involves the operation of:

        a. power-driven woodworking machines, including supervising or controlling the operation of such machines.
        b. sawmill, lathe mill, shingle mill or cooperage stock mill.

        • Work is permitted in offices or in areas not related to the above equipment.
      10. Work in or about places where explosives are manufactured or stored (or products containing explosives).
        • Work may be performed in "non-explosive" areas if proper protection is provided.
      11. Work where there is exposure to radioactive substances and to ionizing radiations.
      12. Work involving slaughtering, meat packing, processing or rendering.
      13. Manufacturing of brick, tile and kindred products except in offices, storage areas, laboratories and storerooms.
